Is Business Litigation the Same as Other Litigations?

When there is litigation between two businesses, there are some very distinct differences in how it works. With business litigation, you will often find that both sides present a claim and a defense, whereas in other forms of litigation, for example personal injury cases, one side is the plaintiff and one side is the defendant.

The reason for this is that in most commercial litigation cases, both sides may have contributed to any “fault,” or to the reasons behind the disagreement.

Will My Case Be Heard in Court?

Your case will not always be heard in court. An interesting feature of business litigation is that there are several different forums in which the dispute may be discussed, negotiated, or litigated. Depending on the type of disagreement and how the respective lawyers see the case best being dealt with, your dispute could be heard in any of these:

  • Administrative hearing
  • Private arbitration
  • State court
  • Federal court
